Sales Terms for Matland Gård

Introduction

This purchase is governed by the standard sales conditions below for consumer purchases of goods over the internet. Consumer purchases over the internet are mainly regulated by the Contract Act, the Consumer Purchases Act, the Marketing Act, the Right of Withdrawal Act, and the E-commerce Act, and these laws give the consumer inalienable rights. The terms of this agreement should not be understood as any limitation on the statutory rights, but establish the parties' most important rights and obligations for the trade.

1. The Agreement

The agreement consists of these sales terms, information provided in the ordering solution, and any specifically agreed terms. In case of any conflict between the information, what is specifically agreed between the parties prevails, provided it does not contradict mandatory legislation.

Hereinafter referred to as «seller» or «us».

Buyer is:
The consumer who makes the order, hereinafter referred to as «buyer» or «you».

3. Price

The specified price for the item and services is the total price the buyer shall pay. This price includes all taxes and value-added tax. Additional costs that the seller has not informed about before the purchase shall not be borne by the buyer.

4. Contract Formation

The agreement is binding for both parties when the buyer has sent their order to the seller.

5. Payment

The seller can demand payment for the item from the time it is sent from the seller to the buyer. If the buyer uses a credit card or debit card for payment, the seller can reserve the purchase price on the card upon ordering. The card is charged on the same day the item is sent.

We offer payment with Vipps and card payment (Stripe).

6. Delivery

Delivery has occurred when the buyer, or their representative, has taken possession of the item.

  • Pickup: Can be done by appointment at Matland Gård.
  • Delivery: We offer delivery in specified zones (Bergen/Surroundings) for a shipping fee. Delivery time is agreed upon separately.

7. Right of Withdrawal

The buyer can withdraw from the purchase of the item under the Right of Withdrawal Act. The buyer must notify the seller of use of the right of withdrawal within 14 days after the period began to run. The period includes all calendar days. If the period ends on a Saturday, public holiday, or day of rest, the period is extended to the nearest working day.

When using the right of withdrawal, the item must be returned to the seller without undue delay and at the latest 14 days after notification of use of the right of withdrawal is given. The buyer covers the direct costs of returning the item.

Exception: For delivery of bulk materials (shingle, gravel, soil) that have been tipped off and mixed with other masses, or which by nature cannot be returned, the right of withdrawal lapses upon delivery.

8. Complaints in Case of Defect and Deadline for Reporting Claims Due to Delay

If there is a defect in the item, the buyer must within a reasonable time after it was discovered or should have been discovered, notify the seller that they will invoke the defect. The buyer has always complained on time if it happens within 2 months from the time the defect was discovered or should have been discovered. Complaints can occur at the latest two years after the buyer took over the item.

9. Conflict Resolution

Complaints are directed to the seller within a reasonable time. The parties shall attempt to resolve any disputes amicably. If this does not succeed, the buyer can contact the Consumer Authority for mediation.

Additional Terms for Booking and Rental

Motorhome Parking / Camping

  • Booking is binding.
  • Cancellation must occur at the latest 24 hours before arrival for a full refund.
  • In case of cancellation later than 24 hours before arrival, the amount is not refunded.
  • Check-in is after 12:00 unless otherwise agreed.

Event Venue / The Boathouse

  • For rental of event venues, a separate rental contract applies which is signed upon booking.
  • Cancellation of event venue must occur at the latest 30 days before the event.
  • In case of cancellation 14-30 days before the event, 50% of the rental sum is invoiced.
  • In case of cancellation less than 14 days before, the entire rental sum is invoiced.
  • The tenant is responsible for any damage to the venue and inventory during the rental period.
